Kenya Moves to Strengthen Aviation Security with New Civil Aviation Regulations

This Regulatory Impact Assessment (RIA) has been prepared by the Ministry of Roads and Transport in fulfilment of the requirements under the Statutory Instruments Act (CAP 2A). It supports the proposed enactment of the Civil Aviation (Security) Regulations 2024, which are intended to update and strengthen the legal framework governing aviation security in Kenya.

Developed under Section 82 of the Civil Aviation Act, the regulations aim to align Kenya’s aviation security standards with international best practices, particularly the latest amendments to ICAO Annex 17. The RIA provides a comprehensive evaluation of the existing regulatory gaps, the policy and legal context, and the implications of implementing the proposed regulations.

The document outlines the objectives, scope, and expected outcomes of the new regulatory framework, with a detailed analysis of alternative options, cost-benefit considerations, and stakeholder impacts. Its ultimate goal is to ensure a safe, secure, and efficient civil aviation system that supports Kenya’s national development goals, facilitates international connectivity, and upholds the highest standards of passenger and cargo security.
